Superintendent Clarifies Minor Injury Regulation (MIR)

On May 17, the superintendent of insurance clarified that the Minor Injury Regulation (MIR) applies to sprain, strain, whiplash injuries, some temporomandibular joint injuries, and physical or psychological conditions or symptoms that arise from sprains, strains, and whiplash injuries and that resolve with those injuries. The MIR limits the pain and suffering damages if the injuries do not result in a serious impairment.

The superintendent also advised of two other changes:

  • Upcoming expiry dates on the Minor Injury Regulation (MIR), Automobile Insurance Premiums Regulation (AIPR), and the Automobile Accident Insurance Benefits Regulation (AAIBR) have been repealed to ensure consistence with the Diagnostic and Treatment Protocols Regulation.
  • Minor technical amendments include aligning the list of surcharge offences in the AIPR with the Traffic Safety Act, the Criminal Code of Canada, and related legislation.
